General Terms and Conditions (AGB)

  1. Scope of Application
    These General Terms and Conditions (AGB) apply to all orders placed via our online shop hempage.de.

  2. Contract Partner
    The purchase contract is concluded with HempAge AG, located at Industriestraße 14, 91325 Adelsdorf. For more information about us, please refer to the imprint. You can reach our customer service for questions, complaints, and claims from Monday to Friday, 10:00 AM - 4:00 PM at support@hempage.de or by phone at (09195) 93201 0.

  3. Conclusion of Contract
    The presentation of products in the online shop does not constitute a legally binding offer but an informal online catalog.
    By ordering the desired goods, you submit a binding offer to conclude a purchase contract for the respective product. We will promptly confirm receipt of your offer, which does not yet constitute acceptance. We are then entitled to accept your offer within 5 calendar days. We can accept your order by sending an order confirmation via email or by delivering the goods. If your offer is not accepted within 5 calendar days, it is considered rejected. No purchase contract is concluded for products not listed in the order confirmation or not delivered. The condition for the effective conclusion of the contract is that the order process is completed by submitting the order.

  4. Delivery
    Delivery is made via DHL to the delivery address provided by you and is only possible within the Federal Republic of Germany. However, the transfer of risk occurs only upon delivery of the goods to the customer.
    If an item is out of stock or if delivery is delayed, we will inform you immediately and provide a new delivery date.
    We reserve the right to make partial deliveries if this seems advantageous for faster processing and is reasonable for you. If partial deliveries are made, we will cover the additional shipping costs. You will incur no additional costs. If we are unable to deliver the goods you ordered due to circumstances beyond our control (e.g., the supplier fails to fulfill their contractual obligations), we expressly reserve the right to withdraw from the contract.

For advance payment and instant transfer payments, the indicated delivery times apply from the moment the payment is received in our account.

  1. Prices and Shipping Costs
    The prices specified at the time of the order apply. These prices are in euros, including the applicable statutory VAT.
    All prices are exclusive of shipping costs.

  2. Payment
    Payment can be made via advance payment, SOFORT Überweisung, PayPal*, or direct debit*.
    All payment methods marked with * are offered by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereafter referred to as "PayPal"). The respective PayPal terms of use apply. For customers with a PayPal account, these can be viewed at: https://www.paypal.com/de/webapps/mpp/ua/useragreement-full. If you do not have a PayPal account, the terms for payments without a PayPal account can be viewed at: https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.

  • Advance payment: If you select the advance payment method, we will provide our bank details in the order confirmation and deliver the goods after payment is received.
  • SOFORT Überweisung.de: We also offer Sofortüberweisung. You only need your account number, bank code, PIN, and TAN. Using the secure payment form from Payment Network AG, Sofortüberweisung automatically processes and transfers the payment in real time to the merchant's bank account. This service is free for customers, with only the bank’s transfer fees applying.

  1. Retention of Title
    The goods remain our property until full payment is made.

  2. Transport Damages
    If goods are delivered with visible transport damage, please immediately report the issue to the carrier and contact us without delay. Failure to file a complaint or contact us does not affect your legal rights and their enforcement, particularly regarding warranty rights. However, it helps us assert our claims against the carrier or transport insurance.

  3. Right of Withdrawal
    If you are a consumer and the contract was concluded using exclusively remote communication methods, and no legal exception applies, you have a right of withdrawal. For details on your statutory rights, please refer to the instructions on our website hempage.de. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or professional activities.

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without providing any reason.
The withdrawal period is fourteen days from the day you or a third party nominated by you (other than the carrier) take possession of the goods.

To exercise your right of withdrawal, you must inform us (HempAge AG, Industriestraße 14, 91325 Adelsdorf, info@hempage.de) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax, or email). You may use the withdrawal form included with each order or the online form on our website, but it is not required.

To meet the withdrawal deadline, it is sufficient for you to send the notification of withdrawal before the withdrawal period expires.

Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs arising from your choice of delivery method other than the least expensive standard delivery offered), without delay and no later than fourteen days from the day we receive your withdrawal notice. We will use the same payment method that you used for the original transaction, unless otherwise agreed; in no event will you incur any fees for this refund. We may withhold the refund until we have received the goods back or you provide proof that you have returned the goods, whichever is earlier.

You must return the goods to us without delay, and in any case within fourteen days of informing us of the withdrawal. The deadline is met if you send the goods before the period of fourteen days expires.
You bear the cost of returning the goods (5€).
You are only liable for any loss in value of the goods if the loss is due to unnecessary handling of the goods to check their condition, characteristics, and functionality.

  1. Statutory Warranty Rights
    In case of defects in delivered goods, the statutory rights apply.
    The warranty period is two years from delivery. During this period, all defects covered by the statutory warranty will be corrected free of charge.

In the event of a warranty claim, you are initially entitled to supplementary performance (either repair or replacement). If the chosen form of supplementary performance is not possible or would incur disproportionate costs, the claim will be limited to the other form of supplementary performance. If this is also not possible or would incur disproportionate costs, HempAge AG is entitled to refuse supplementary performance. In this case, and in the case of unsuccessful supplementary performance, you may request a reduction in price or withdraw from the contract in accordance with legal regulations.

  1. Set-Off
    The right of set-off is only available to the customer if their counterclaims have been legally established or are undisputed by HempAge AG. The customer is only entitled to exercise a right of retention to the extent that their counterclaim is based on the same contractual relationship.

  2. Storage of Contract Text
    We store the contract text and send the order data and our General Terms and Conditions by email.
    You can view and download the General Terms and Conditions at any time on this page. You can also view your past orders in our customer login.

  3. Contract Language
    The language available for the conclusion of the contract is German.

  4. Links / Copyright
    If HempAge AG provides links to other websites, we explicitly point out that these are external contents for which HempAge AG cannot assume any liability. The linked pages were checked for legal violations at the time of linking, but no violations were detected. However, ongoing monitoring of the linked pages without specific indications is unreasonable. If legal violations become known, HempAge AG will immediately remove the relevant links.

Copyright-protected content, including images, texts, designs, etc., may not be used without prior written permission from HempAge AG, and may not be reproduced or published in any other way.

  1. Applicable Law
    The law of the Federal Republic of Germany applies, excluding the UN Sales Convention, unless mandatory international consumer protection law stipulates otherwise.

  2. Online Dispute Resolution
    To resolve consumer disputes out of court, the European Union has established an online platform ("OS platform"). You can find it at:

We are not obliged to participate in dispute resolution procedures before a consumer dispute resolution body and are generally not willing to do so.

    If any provision of these terms and conditions is or becomes invalid, the validity of the remaining provisions shall not be affected.
